FORECLOSURE PROCESS

  1. Homeowners stop making mortgage payments.
  2. After 15-30 days, lender sends a payment reminder.
  3. After missing monthly 2-3 payments, the lender transfers property over to an outside trustee.
  4. The trustee sends an official NOD (Notice of Default) and the foreclosure process begins.
  5. The trustee begins the foreclosure process by posting a foreclosure notice in the county's legal newspaper or in the local newspaper.
  6. If monthly payments are not made on the property for the next 3-4 months the Bank (Beneficiary) has multiple options.
  7. Sell it on the courthouse steps, put the property up for auction or hire a Realtor and put it on the open market.
  8. Most banks will do all three to get the home sold.

A Short Sale occurs when the home owner owes more on the home than what they can sell it for or the current market will bare. In a short sale, the bank may accept less money than what is owed in order to the remove the bad debt from their books, letting the homeowner off the hook the balance.
